Heard Mr. K.K. Mishra, learned Counsel for the Petitioner and Mr. J. P. Patnaik, learned Government Advocate for the State. 3.

The petitioner has filed this Writ Petition seeking direction to the Opposite Parties not to demolish his residential house. 4.

Mr. K. K. Mishra, learned counsel for the Petitioner contended that the petitioner is occupation of land in mouza Bhubaneswar Sahar unit No. 41, Chandrasekharpur over plot No. 321 (p), Khata No. 619, measuring an area of Ac.0.12 decimal out of total ac. 166.4496 dec. According to him the said land has been granted by the King of Kanika in favour of the petitioner. However after vesting the land has been recorded in the name of the government.

Since challenging the steps to be taken by the authorities for eviction of the petitioner, the petitioner has approached this Court in the present Writ Petition, this Court is not inclined to entertain the prayer made in this Writ Petition. However, liberty is granted to the

petitioner to pursue their remedy before the appropriate authority by filing objection, if he is so advised, so that the matter can be considered and appropriate orders can be passed in accordance with law.
