Sabita Sethi v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.A. No. 527 of 2019 Sabita Sethi ....
Appellant Mr. P. K. Parhi, Advocate -versusState of Odisha and others ....
Respondents Mr. Nikhil Pratap, ASC
CORAM:
THE CHIEF JUSTICE JUSTICE M.S. RAMAN
ORDER
07.12.2022 Order No.
I.A. No.841 of 2019 02.
1. For the reasons stated therein, the delay of 15 days in filing the appeal is condoned. The application is allowed. W.A. No.527 of 2019
2. During the pendency of the writ petition itself, a fresh advertisement had been issued on 26th July, 2019 for filling up the posts of Anganwadi Worker (AWW) in several Anganwadi Centres (AWC) including the one with which the present appeal is concerned. There has been no stay of the impugned order of the learned Single Judge dismissing the Appellant's writ petition declining to interfere with the impugned order disengaging her. Clearly, the new incumbent must be in position since the fresh advertisement was issued over three years ago and there is no question now of putting the clock back to accommodate the present Appellant.
3. In that view of the matter, in view of the subsequent developments, this Court is disinclined to interfere with the impugned order of the learned Single Judge.
4. The appeal is accordingly dismissed.
(Dr. S. Muralidhar) Chief Justice (M.S. Raman) Judge Deepak
