Case involving here has cause of action to be involved a criminal proceeding and case also involving detention appears to be illegal detention.

In the circumstance this Court does not find the Civil Writ Petition is maintainable.

Learned counsel for the Petitioner wants to withdraw the Writ Petition with liberty to bring the litigation under appropriate nomenclature.

The Writ Petition stands dismissed as withdrawn but however with liberty as prayed for. Certified copy of Annexure-3 be returned to the Petitioner by retaining the Xerox copy.
