Heard Mr. A. Mishra, learned counsel for the petitioner and Mr. A.K. Mishra, learned Additional Government Advocate for the State.

Against the eviction notice issued under Annexure-2, the petitioner has approached this Court in the present writ petition. 4.

Mr. A. Mishra, learned counsel for the petitioner contended that the petitioner is in occupation of the land in question for the last twenty years and as such similarly situated persons have been allowed to continue in the said area, but the petitioner has been issued notice for eviction.

Mr. A.K. Mishra, learned Additional Government Advocate contended that against notice of eviction, the petitioner has to file reply before the authority, so that the authority can pass appropriate order and that order itself is appeasable one. 6.

Having heard learned counsel for the parties and after going

through the records, since the petitioner has come against the notice of eviction, it is open for him to file objection to the said notice, so that the authority will pass appropriate order in accordance with law.
