This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in C.T. Case No.1350 of 2022, pending in the file of learned SDJM, Baripada, arising out of Bangiriposi P.S. Case No.163 of 2022, offence under Sections 399/402 of IPC.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Baripada by order dated 23.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is stated that the petitioners are in custody since 28.07.2022 and since charge sheet has already been filed on 14.08.2022, his further continuance in custody is not called for. 6.

It is further submitted that petitioner Nos.1 and 3 are the first offender.

Learned counsel for the State opposes the prayer for bail more particularly, taking into account the nature of allegations and that the petitioners are named in the FIR.

Taking into account the nature of allegations and filing of charge sheet, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view criminal proclivity of the petitioner No.2 this Court directs that his to appear before the jurisdictional police station once in every week till the conclusion of trial. 10.

Accordingly, the BLAPL stands disposed of.
