This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in C.T. Case No.115 of 2022, pending in the file of learned JMFC, Harbhanga, arising out of Purunakatak P.S. Case No.74 of 2022, offence under Sections 457/380 of IPC.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned District and Sessions Judge, Boudh by order dated 03.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the petitioners are in custody since 11.07.2022 and out of the amount of Rs.1,00,000/- (Rupees One Lakh Only) involved in the offence Rs.80,000/- (Rupees only Eighty Thousand Only) have been recovered from one Harihar Pradhan who has been released by the investigating agency as the

prosecution could not file the charge sheet within the stipulated period.

Taking into account the nature of allegations and the punishment prescribed, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view criminal proclivity of the petitioners this Court directs that they shall appear before the jurisdictional police station once in every week till the conclusion of trial. 8.

Accordingly, the BLAPL stands disposed of.
