1. This matter is taken up through hybrid mode.

2. This CMAPL has been filed to recall the Order dated 25.08.2022 and to restore W.P.(C) No.920 of 2017 to its original file.

3. It is stated that since the name of the learned Counsel for the Petitioner was wrongly reflected as "Diptiranjan Bhota" on 25.08.2022 in the Cause List, he could not know about listing of the case on 25.08.2022 and, accordingly, could not appear before this Court on the said date of listing. To substantiate the said stand taken in the restoration petition, a copy of the Supplementary List has been annexed as Annexure-1.

4. In view of the averments made in the CMAPL, so also submission made by the learned Counsel for the Petitioner, the CMAPL is allowed.

5. The Order dated 25.08.2022 passed in W.P.(C) No.920 of 2017 is hereby recalled. Accordingly, the said Writ Petition be restored to its file.
