This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Jharsuguda Sadar P.S. Case No.180 of 2021 corresponding to C.T. Case No.2262 of 2021, pending in the Court of the learned S.D.J.M., Jharsuguda, for the alleged commission of offences under Sections 341/294/323/324/325/307/427/506/34 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jharsuguda, by order dated 25.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner relying on the order of rejection that co-accused persons have been allowed to be released on bail by learned Sessions Judge, Jharsuguda in BLAPL No.287 of 2022 by order dated 09.08.2022.

It is also borne out from record that other co-accused persons have already been released on bail by order of learned Sessions Judge, Jharsuguda dated 28.10.2021 in BLAPL No.432 of 2021 and by the learned ADJ-cum-PO Special Court, POCSO, Jharsuguda dated 23.08.2022 in BLAPL No. 337 of 2022. 7.

Keeping in view the release of the co-accused as noted, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.

Accordingly, the BLAPL stands disposed of.
