This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction to provide power supply to her premises on complying with formalities.

It is submitted by Mr. Mohanty, learned counsel that the Petitioner is a purchaser of the land in question from the recorded tenant. She is in possession over the same. The authorities under TPCODL on the plea that an order of status quo is continuing in respect of the said premises are not providing power supply to the premises of the Petitioner. It is his submission that supply of electricity is a fundamental right of a citizen and it cannot be denied at any cost. In that view of the matter, he prays for the aforesaid direction. 4.

Taking into consideration submission made by learned counsel for the Petitioner, this Court is of the considered opinion that right of the Petitioner, if any, for supply of

// 2 // electricity is subject to the statutory provisions and orders of competent Court of law. In the instant case, there is an order of status quo dated 1st December, 2021 passed by learned Civil Judge (Senior Division), Bhubaneswar in I.A. No.1 of 2021 (arising out of C.S. No.2569 of 2021). In that event, if any power supply is provided to the premises of the Petitioner, it may amount to violation of the said order.

In view of the above, this writ petition is disposed of with an observation that the Petitioner, if so advised, may move learned trial court for appropriate direction. Urgent certified copy of this order be granted on proper application.
