This application has been filed by the petitioner-husband under Section 24 of C.P.C. for transfer of MAT Suit No.20 of 2019 filed by the opposite party-wife under Section-13 (1) (i-a) of the Hindu Marriage Act in the Court of learned Civil Judge (Senior Division), Chhatrapur, Ganjam, to the Court of learned Judge, Family Court, Bhubaneswar. 2.

Mr.U.C.Dora, learned counsel appearing on behalf of Mr.Ranjit Mohanty, learned counsel for the petitioner files a memo signed by Mr.Mohanty in Court today stating that the TRP (C) No.386 of 2019 filed earlier by the petitioner has been disposed of by order dated 5.7.2021. No supervening ground has been taken in this petition and that the petition is incomplete. Therefore, he seeks permission to withdraw the transfer petition with liberty to file a fresh petition. The memo for withdrawal be kept on record.

Considering the above averments, the TRP (C) is permitted to be withdrawn granting the liberty prayed for.
