This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Bhawanipatna Town P.S. Case No.127 of 2022 corresponding to C.T. Case No.356 of 2022, pending in the Court of the learned S.D.J.M., Bhawanipatna, for the alleged commission of offences under Sections 417/420/294/34 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge (Vigilance), Bhawanipatna, by order dated 26.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the petitioner that because of his criminal proclivity, he is being falsely implicated in the case at hand and he is in custody since 16.05.2022. It is
submitted that since the investigation has progressed substantially, further continuance of the petitioner in custody is not warranted. 7.
Learned counsel for the State opposes the prayer for bail relying on the order of rejection which states regarding the involvement of the petitioner in several similar offences. 8.
Taking into account the nature of allegations and the period of remand in the case at hand and the overall custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 9.
Keeping in view the criminal proclivity of the petitioner, it is directed that the petitioner shall appear before the jurisdictional police station once every week till conclusion of trial. 10.
Accordingly, the BLAPL stands disposed of.
