This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in P.R. No.40/2022-23 corresponding to 2 (a) CC No.25 of 2022, pending in the Court of the learned Special Judge-cum-Sessions Judge, Jharsuguda, for the alleged commission of offences under Section 20(b)(ii)(B) of NDPS Act.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Jharsuguda, by order dated 23.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account that the quantity seized is less than the commercial quantity and considering the age of the petitioner and the basis of implication, this Court directs the petitioner to be

released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
