This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as, learned Additional Standing Counsel for the State.

This is an application under Section 439 of the Criminal Procedure Code filed by the Petitioner to release him on regular bail in connection with Spl. G.R.Case No. 11 of 2021 pending in the Court of the learned Children's Court-cum-Special Court under POCSO Act, corresponding to Salipur P.S.Case No.14 of 2021 for commission of the alleged offences under Sections 450, 376(D)(A), 376(3),376(2)(n), 506 of Indian Penal Code read with Section 6 of POCSO Act and Section 3(2)(v) of S.C. & S.T.(POA) Act..

Learned counsel for the Petitioner does not want to press this application at this juncture with liberty to file a fresh application after examination of the victim girl in this case.

Considering the aforesaid submission, this Court disposes of the bail application as not pressed with liberty to the Petitioner to move a fresh bail application after the victim girl is examined in this case by the trial court. Further the trial court is directed to expedite the trial and if possible the victim girl be examined at the earliest. 6.

With the aforesaid observation, the bail application is disposed of.

Urgent certified copy of this order be granted on proper application.
