This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused Joda P.S. Case No.190 of 2022 corresponding to G.R. Case No.545 of 2022, pending before the Court of the learned J.M.F.C., Barbil, for the alleged commission of offences under Sections 457/380/34 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Champua Camp at Barbil, by order dated 06.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Learned counsel for the petitioner submits that the chargesheet has already been filed on 31.08.2022 and he is in custody from 20.07.2022, hence further continuance of the petitioner in custody is not warranted and it is also stated that the stolen article i.e. iron desks, have already been recovered and that one co-accused
similarly circumstanced have been released on bail by this Court in BLAPL No.8327 of 2022.

Learned counsel for the State opposes the prayer for bail. 7.
Taking into account the submissions made at the Bar, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.
Accordingly, the BLAPL stands disposed of.
