Heard Mr. S. Patra on behalf of Mr. S. Mishra, learned counsel for the petitioner and Mr. S. Jena, learned Standing Counsel for School and Mass Education Department.

The petitioner has filed this writ petition seeking direction to the opposite parties to extend them the benefits in terms of the judgment passed by this Court in W.P.(C) No.31679 of 2011 disposed of on 05.03.2020 (Dhananjay Charan Dey v. State of Orissa) under Annexure-2. 4.

Mr. S. Patra, learned counsel for the petitioner contended that the petitioner is one of those 619 eligible teachers working as Sikhya Sahayak and her services should have been regularized taking into consideration their initial date of appointment.

Mr. Jena, learned Standing Counsel for School and Mass Education Department contended that nothing has been placed on record to indicate whether the petitioner belongs to those 619 eligible teachers and was working as Sikhya Sahayak or not. In any case, if the petitioner belongs to those 619 eligible teachers, as per the judgment under Annexure-2, her case shall be considered in accordance with law.

Considering the contention raised by learned counsel for the parties and after going through the records, this writ petition stands disposed of

granting liberty to the petitioner to file a fresh representation before the authority concerned within two weeks hence raising all the grievances raised in this writ petition. If such a representation is filed, the same shall be considered by the authority taking into consideration the law laid down by this W.P.(C) No. 20933 of 2020 Court in Dhananjay Charan Dey mentioned supra, as expeditiously as possible, preferably within a period of three months from the date of communication/production of certified copy of this order. 7.

Issue urgent certified copy as per rules.
