This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in T.R. No.216 of 2022 corresponding to G.R. Case No.335 of 2022 in Jatni P.S. Case No.190 dt.26.05.2022, pending in the Court of the learned Special Judge (POCSO) -cum- Additional Sessions Judge, Bhubaneswar, Khurda, for the alleged commission of offences under Sections 363/366/376(2)(n) of IPC read with Section 6 of POCSO Act. 4.
Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge (POCSO) -cumAdditional Sessions Judge, Bhubaneswar, by order dated 08.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement.

Considering the tenor thereof and taking into account the submission of learned counsel for the petitioner that charge-sheet
has already been filed on 08.08.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
