1. It appears that the Petitioner is facing trial for the offence under Sections 376 read with Section 302 of the IPC. In this case the key prosecution witnesses have already been examined. Mr. Das, Learned Additional Standing Counsel for the State, on examination of the depositions of the key witnesses states that the key prosecution witnesses in fact have turned hostile.

2. In that view of the matter, the Petitioner has made out an arguable case for grant of bail at this stage. He has been in custody since 30th July, 2020.

3. The Petitioner is directed to be enlarged on bail subject to the satisfaction of the Trial Court and subject to the additional conditions regarding (i) restrictive movement of the Petitioner/ Applicant beyond the limits of his usual residence and (ii) to report the local Police Station periodically being incorporated in the bail order.

4. The Trial Court will incorporate the above conditions in an appropriate manner in the Bail order.
