The Petitioner in this writ petition prays for a direction to the Tahasildar, Sadar Sambalpur to settle Plot No.224 to an extent of Ac.0.200 decimals under Khata No.240 situated in Mouza Sambalpur Town Unit-16 (Sarala) under Dhanupalli Tahasil in the district of Sambalpur in her name. 3.
It is submitted by Mr. Khuntia, learned counsel for the Petitioner that the Petitioner is a vegetable vendor and is residing over the aforesaid piece of land since 1960. As she is a landless person, she made an application on 24th March, 2012 as at Annexure-5 to the competent Authority, namely, the Tahasildar, Sadar, Sambalpur-Opposite Party No.3 for settlement of Government land under the provisions of the Odisha Government Land Settlement Act and Rules framed thereunder. It is his contention that although said application was filed in the year, 2012, the same has not yet been considered. Several endeavours made by the Petitioner for consideration of the said application went in vain. Hence, this writ petition has been filed.

Mr. Mishra, learned Additional Government Advocate submits that there is no material on record to show that Annexure-5 was, in fact, received by the Tahasildar, Sadar, Sambalpur. It is also not clear as to whether the Petitioner had ever filed the said application accompanying relevant documents. Hence, prayer of the Petitioner cannot be entertained in this writ petition.

In course of hearing, Mr. Khuntia, learned counsel for the Petitioner submits that interest of justice will be best served, if the Petitioner files a fresh application in proper format along with requisite information and relevant documents for settlement of the aforesaid Government land in her favour. Hence, he prays for withdrawal of the writ petition to enable the Petitioner to move such application.

Considering such submission, this writ petition is disposed of as withdrawn.
Urgent certified copy of this order be granted on proper application.
