Opp. Parties Mr. Swayambhu Mishra, Additional Standing Counsel
CORAM:
JUSTICE K.R. MOHAPATRA
ORDER
Order No.
27.09.2022 1.
1.
This matter is taken up through hybrid mode.
2.
The grievance of Petitioners in this writ petition is with regard to installation of tower and drawal of high tension line over their residential house in Plot No.2591 under Khata No. 1960 situated in mouza Brhamabarada in the district of Jajpur. 3.
Mr. Panda, learned counsel for the Petitioners submits that before installation of tower and drawal of high tension line over the aforesaid land, the Petitioners were not issued with any notice. It is his submission that the aforesaid land is only residential plot of the Petitioners and if high tension line is drawn, they will not be in a position to make further construction over the land. It is also hazardous on their part to live in their house. In that regard, the Petitioners have made a grievance petition to the SubDivisional Officer (Electrical), TPCODL, Kuakhia, Jajpur on 27th July, 2022 under Annexure-3, but no decision has yet been taken on the same. Hence, this writ petition has been filed for the aforesaid relief.
// 2 // 4.
Taking into consideration the submission made by learned counsel for the Petitioners, this Court feels that the Petitioners should submit their grievance petition before the Executive Engineer (Electrical), TPCODL, Jajpur-Opposite Party No.4, who will be in a position to redress their grievances. 5.
In that view of the matter, this Court without expressing any opinion on the merits of the case of Petitioners disposes of this writ petition with a direction that in the event the Petitioners file a grievance petition/representation before Executive Engineer (Electrical), TPCODL, Jajpur-Opposite Party No.4 within a period of two weeks hence along with certified copy of this order, he shall do well to consider the same and take a decision thereon in accordance with law as expeditiously as possible preferably within a period of four weeks therefrom and communicate the result thereof to the Petitioners forthwith.
Urgent certified copy of this order be granted on proper application.
