Heard learned counsel for the petitioner and learned counsel for the State.

The instant petition under Section 482 Cr.P.C. is at the behest of the petitioner with a prayer for early disposal of the case in C.T. No.1255 of 2016 arising out of Remuna P.S. Case No.95 of 2016 pending in the file of learned J.M.F.,C.(R), Balasore on the grounds stated therein.

Mr. Jena, learned counsel for the petitioner submits that chargesheet was filed in the year 2016 and in the meantime, the accused persons have entered appearance and the case is pending for supply of police papers and except the above, there has been no progress in the enquiry and considering the fact that petitioner is the informant, he has therefore prays for early disposal of the case. A copy of the chargesheet is at Annexure-1. After the FIR was lodged in the year 2016, Remuna P.S. Case No.95 of 2016 was registered and thereafter, chargesheet was filed under Sections 341/294/506 read with Section 34 IPC. It is submitted that despite the chargesheet

having been filed in the year 2016, no real progress has been achieved except the fact that the court below has taken cognizance of the offences. It is claimed that the case is pending for supply of police papers for long and in the mealtime six years have gone by. 4.

From the submission of Mr. Jena, it is made to understand that ever since chargesheet has been filed, there has been no meaningful progress made and the case is still awaiting supply of police papers. Having regard to the above facts, the Court is of the view that learned court below should be directed to commence the enquiry at the earliest and expedite the trial. 5.

In the result, the CRLMC stands disposed of with a direction to the learned J.M.F.,C.(R), Balasore to ensure immediate commencement of enquiry and trial for early disposal of C.T. No.1255 of 2016 arising out of Remuna P.S. Case No.95 of 2016 and complete the entire exercise within a period of six months from the date of receipt of certified copy of the above order. 6.

Issue urgent certified copy as per rules.
