Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 13.02.2021 in connection with Nilagiri P.S. Case No.362 of 2021 corresponding to S.T. Case No.89/132 of 2022 pending in the Court of learned 2nd Addl. Sessions Judge, Balasore for the alleged commission of offence under Sections 302/34 of IPC read with Section 25/27 of Arms Act.

The petitioner's earlier bail application was rejected by this Court as per order passed in BLAPL No.1686 of 2022 granting him liberty to renew his prayer after examination of witnesses, Abdul Rifaz Quadri and Raja Singh during trial. It is submitted that in the meantime both of them have been examined as witnesses. Copies of deposition of said witnesses have been enclosed to the bail application. It is
seen that both of them have turned hostile.

Considering the above fact and the taking into account the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting of the case and in case of even a single default, necessary orders shall be passed to take him to custody again.

BLAPL is accordingly disposed of.
