Nanda Behera v. State Of Orissa
IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLMC No.1787 of 2016 Nanda Behera ....
Petitioner Mr. S. Panda, Advocate -versusState of Orissa and another ....
Opp. Parties Mr. S.R. Roul, A.S.C.
CORAM:
JUSTICE G. SATAPATHY Order No.
ORDER
28.09.2022 03.
1.
This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2.
None appears for the petitioner at the time of call, so also no one had appeared on the last date on 19.09.2022. The petitioner by way of an application U/S. 482 of Cr.P.C. seeks to quash the order dated 02.05.2015 passed by learned Additional Sessions Judge, Dhenkanal in C.T. (SS) Case No.229 of 2013 refusing to discharge the petitioner but no stay has been granted by this Court from proceeding further in the criminal case and in the meantime, around seven years have passed from the date of passing of impugned order. In view of the above facts, this Court reasonably entertains a doubt as to whether the cause of action still survives for the petitioner in this case.
3.
In view of such, the CRLMC is dismissed.
