Mr. J.K. Rath, learned Senior Advocate appearing for the petitioner has filed a memo in which it is indicated as follows:

"The petitioner files this writ application for non-consideration of the appointment of the petitioner to the post of Associate Professor in the faculty of Food Process Engineering of National institute of Technology, Rourkela. After the notice was issued to the Opp.Parties and

// 2 // after filed their counter affidavit and the rejoinder thereto the matter was heard. During the pendency of the final hearing of the case, the Opp.Party No.1 vide order dated 17.10.2022 passed an order to appoint the petitioner as Associate Professor in Food Process Engineering w.e.f. 02.02.2018 and the petitioner was requested to submit his joining report by 21.10.2022.

Accordingly, the petitioner submitted his joining report on 17.10.2022. A copy of the appointment order and joining report is annexed for the records shake."

Learned counsel for the petitioner submits that in view of change in the circumstances the writ petition may be disposed of.
