Heard learned counsel for the Parties.

Order No.

The Writ Petition involves the following prayer :- "Under the above facts and circumstances, it is humbly prayed that the Hon'ble Court may graciously be pleased to admit the writ application, to issue notice to the Opp.Parties and after hearing to direct the Opp.Parties for handing over the actual physical possession of purchase property i.e. 1, BHK, Tuype-2, Flat No.G-409 under BDA Housing Project, Paikarapur-1(1531) within time specified by this Hon"ble Court..."

Considering the pendency of representations at Pages-15 & 16 of the Brief before the Secretary, B.D.A., Bhubaneswar and finding the Writ Petition premature, this Court simply directs the Secretary, B.D.A., O.P.3 to take lawful decision on the

// 2 // representations of the Petitioners at Pages-15 & 16 of the Brief at the instance of the Petitioner and pass appropriate order, if necessary, involving the Petitioner, at least within a period of six weeks from the date of communication of this order.
