This matter is taken up through hybrid mode.

Heard learned Senior Counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Chandipur P.S. Case No.66 of 2021 corresponding to C.T. Case No.675 of 2021, pending in the Court of learned S.D.J.M., Balasore, for alleged commission of offences under Sections 272/273/34 of IPC and Section 52 (a) of the Odisha Excise Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 3rd Additional Sessions, Balasore, by order dated 29.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and the punishment prescribed and considering the submission at the Bar by the learned counsel for the petitioner that there has been no casualty though the implication is under Section 272/273 of the IPC, this

Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 6.

Keeping in view the criminal proclivity of the petitioner, it is directed that the petitioner shall appear before the Investigation Officer once every week till the conclusion of investigation. 7.

Accordingly, the BLAPL stands disposed of.
