This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Biramitrapur P.S. Case No.124 of 2022 corresponding to G.R. Case No.66 of 2022, pending before the learned J.M.F.C., Biramitrapur, for alleged commission of offences under Section 468/471/420 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Rourkela, by order dated 26.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 13.06.2022 and as charge-sheet has already been filed on 07.08.2022, further continuance of the petitioner for alleged defalcation of an amount of Rs.2,76,220/- (Rupees two lakh seventy six thousand two hundred twenty) is not warranted.

Taking into account the nature of allegations which is prima facie based on documents, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Additionally it is directed that the petitioner shall furnish cash security to the tune of Rs.75,000/-(Rupees seventy five thousand) which shall be kept in short term interest bearing account pledged to the learned Court in seisin over the matter subject to the final outcome.

Accordingly, the BLAPL stands disposed of.
