This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in G.R. Case No.49 of 2022, pending on the file of the learned J.M.F.C., Mohana awaiting for F.F., arising out of Adava P.S. Case No.36 of 2022, offences under Sections 376(2)(n)/313/294/323/354/34 of IPC and is in custody since 06.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Asst. Sessions Judge, R.Udayagiri, by order dated 24.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

This Court had occasion to go through the 164 Cr.P.C. statement submitted by the learned counsel for the petitioner, which is taken on record.

Taking into account the tenor of the same and that charge sheet has already been filed in the meanwhile, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
