This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.353 of 2021, pending in the Court of learned J.M.F.C., Rural, Rourkela, arising out of Jhirpani P.S. Case No.43 of 2021, for offences under Sections 387/506/507 of IPC read with Section 66-D of IT Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Rourkela, by order dated 01.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that because of the criminal antecedent of the petitioner, he has been falsely implicated in the case at hand and it is further submitted that the co-accused have already been released on bail by the learned Court in seisin over the matter.

Taking note of the submission and his age, the petitioner prays to be released on bail.

Learned counsel for the State opposes the prayer for bail, keeping in view the role ascribed to the petitioner and it is submitted that the petitioner cannot be treated at par with other coaccused since the petitioner is the leader of the movement. 8.

Considering the allegations and keeping in view that charge-sheet has already been filed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking note of the criminal antecedents of the petitioner as pointed out by the learned counsel for the State, this Court directs that the petitioner shall appear before the jurisdictional police station once every month till conclusion of trial. 10.

Accordingly, the BLAPL stands disposed of.
