This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in C.T. Case No.147 2022, pending on the file of the learned JMFC, Soro, arising out of Soro P.S. Case No.58 of 2022, offences under Sections 52(a) of the Orissa Excise Act read with Sections 272/273/34 of IPC. 4.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned A.D.J.-cum-P.O. Designated Court, OPID, Balasore, by order dated 01.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Perused the order of rejection.

Taking into account the nature of allegations and the punishment prescribed, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view the criminal proclivity of the petitioners this Court directs that they shall appear before the I.O. once every week till the submission of charge sheet.

Accordingly, the BLAPL stands disposed of.
