This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.64 of 2022, pending on the file of the learned Special Judge, Gajapati, Paralakhemundi, arising out of Adava P.S. Case No.74 of 2022, offences under Sections 20(b)(ii)(c)/25/29 of the NDPS Act and is in custody since 04.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Gajapati, by order dated 28.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that he has filed an I.A. for interim release of the petitioner. 6.

Since the consideration by the learned Court in seisin over the matter was during the course of investigation, this Court is not inclined to entertain this bail application at this stage.

Learned Court below shall consider the same I.A. on its own merits along with the bail application even before filing of charge sheet, if so moved.

Accordingly, the BLAPL as well as I.A. stands disposed of.
