1. Learned counsel appearing for the Appellants seeks leave to withdraw this present appeal with liberty to file a review petition before the learned Single Judge in view of the submissions made by him that the decision of the Supreme Court in Director, Elementary Education v. Dibakar Pradhan (SLP Civil Appeal No.2104 of 2004 disposed of on 16.02.2010) does not apply to the facts of the present case, since the School in question has already been taken over by the Government.

2. Accordingly, the writ appeal is disposed of as withdrawn with liberty as prayed for.
