IN THE HIGH COURT OF ORISSA AT CUTTACK

W.P.(C) No.22780 of 2022 Kuni Behera & Ors.

....

Petitioner(s) Mr. K. Mishra, Advocate -versusState of Odisha & Ors.

....

Opposite Party(s) Mr. U.K. Sahoo, Addl. Standing Counsel

CORAM:

JUSTICE BISWANATH RATH

ORDER

22.09.2022 01.

1.

This Writ Petition involves a challenge to the order passed by Order No.

the competent authority in disposal of the demarcation Misc. Case No.12/2020.

2.

Taking this Court to the verity of the grounds in the writ petition and also some development through the criminal proceeding, learned counsel for the Petitioner attempted to justify his claim that there has been sufficient material placed before the competent authority undertaking the demarcation process for considering as to whether the demarcation exercise will be undertaken or not. 3.

Entire reading of the brief this Court nowhere finds placing of these grounds before the competent authority prior to undertaking of the exercise of demarcation. Since this Writ Petition involves surprising grounds, this Court is not inclined to entertain the same.

// 2 // 4.

The Writ Petition is, accordingly, dismissed. (Biswanath Rath) Judge Ayaskanta Jena
