This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.570 of 2021, pending in the file of learned S.D.J.M. (Athagarh) arising out of Khuntuni P.S. Case No.171 of 2021, offence under Sections 379/201/411/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Athagarh by order dated 29.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that co-accused Pratap Pradhan was released on bail by this Court by order dated 19.07.2022 in BLAPL No.5871 of 2022 and as charge sheet has already been filed on

31.08.2022 and the petitioner is in custody since 22.03.2022, further continuance of the petitioner is not warranted. 6.

Learned counsel for the State opposes the prayer for bail on the ground of antecedents.

Taking into account the nature of allegations and filing of charge sheet and punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner shall appear before the jurisdictional police station once in every week till the conclusion of trial.

Accordingly, the BLAPL stands disposed of.
