This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as, learned Additional Standing Counsel for the State.

This is an application under Section 439 of the Criminal Procedure Code filed by the Petitioner to release him on regular bail in connection with G.R.Case No.49 of 2020 (N) pending in the Court of the learned Sessions Judge-cum-Special Judge, Ganjam, Berhampur, corresponding to Pattapur P.S.Case No.302 of 2020 for commission of the alleged offence under Sections 363, 376, 114, 343, 506/34 of the Indian Penal Code read with Sections 20(b)(ii) C of NDPS Act, 1985. 4.
Learned Counsel for the Petitioner seeks leave of this Court to withdraw the bail application at this juncture with a direction to the trial court to expedite the trial and conclude the same within a period of four months.

Accordingly, the bail application is disposed of as withdrawn with a direction to the trial court to make endeavour to expedite the trial and conclude the same within a period of four months from the date of production of certified copy of this order, failing which it is open for the Petitioner to move a fresh application for bail before the trial court. In the event such an application is filed by the Petitioner, the same shall be considered in accordance with law. 6.
With the aforesaid observation, the bail application is disposed of.

Urgent certified copy of this order be granted on proper application.
