This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1266 of 2022, pending in the file of learned J.M.F.C., Chandikhol arising out of Balichandrapur P.S. Case No.279 of 2022, offence under Sections 341/323/294/324/307/354/379/506/34 of IPC and is in custody since14.08.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Jajpur by order dated 01.09.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that one of the co-accused has released on anticipatory bail by this Court by order dated 30.08.2022 in ABLAPL No.10296 of 2022.

Considering the order of rejection that the injuries suffered are simple in nature and that the petitioner has no criminal antecedents and release of the co-accused in the while, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter 7.
Accordingly, the BLAPL stands disposed of.
