Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.133 of 2019 pending on the file of learned S.D.J.M., Kamakshyanagar, arising out of Kamakshyanagar P.S Case No.80 of 2019, for commission of alleged offence under Section 302/201 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C by the learned Addl.

Sessions Judge, Kamakshyanagar by order dated 19.08.2022 in the aforementioned case, the present BLAPL has been filed.

Since the consideration by the learned Court in seisin was prior to the charge sheet, this Court is not inclined to entertain this bail application at this stage.

Liberty is given to the Petitioner to renew his prayer before the learned Court in seisin, which shall be considered on its own

merits without being influenced by the earlier rejection or the order passed by this Court.

Accordingly, the BLAPL stands disposed of.
