This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in 2(a) C.C. Case No.28 of 2022, pending in the file of learned J.M.F.C., Bhapur arising out of Excise Station Khandapada P.R. Case No.46 of 2022-23, offence under Sections 52(a) of the Odisha Excise Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Assistant Sessions Judge, Khandapara by order dated 30.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into the nature of allegations and the punishment prescribed and that the petitioner is in custody since 24.08.2022 and substantial progress in the investigation, this Court directs the

petitioner to be release on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
