This matter is taken up through Hybrid Arrangement (Virtual/ Physical Mode).

Heard learned counsel for the petitioner learned counsel for the State.

The Petitioner is an accused in connection with T.R. Case No.64 of 2020 arising out of Jeypore Sadar P.S. Case No. 158 of 2020 on the file of learned District & Sessions Judge-cum-Special Judge, Koraput-Jeypore, registered for the alleged commission of offence under Sections 20(b)(ii) (C) of the NDPS Act. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned District & Sessions Judgecum-Special Judge, Koraput-Jeypore, by order dated 10.09.2020, the present BLAPL has been filed.

Taking into account the role ascribed to the petitioner and in view of the bar Under Section 37 of the NDPS Act, this Court

is not inclined to exercise the discretion under Section 439 Cr.P.C. at this stage.

The BLAPL is accordingly, dismissed.

7.

It shall be open to the petitioner to renew his prayer for bail after examination of some of the witnesses. .
