Heard learned counsel for the petitioner and Mr.A.K.Mishra, learned Addl. Government Advocate for the State.

The petitioner has filed this present writ petition assailing the order dated 03.10.2018 passed by the learned State Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.3083 (C) of 2012, rejecting his claim for grant of compassionate appointment due to death of his father.

Shockingly stated, this is a case where for the death of a government employee, the petitioner as well as his mother had been implicated and put to trial before the learned Sessions Judge and on being acquitted, the petitioner filed the original application before the tribunal for grant of compassionate appointment. The Tribunal, while deciding the original application, took into consideration all aspects and came to hold that the claim for compassionate appointment after 20 years of the death of his
father is not tenable in law and accordingly rejected the claim of the petitioner due to laches of explanations. Therefore, this Court is of the view that there is no illegality or impropriety in the order passed by the Tribunal, so as to interfere with the same. 5.
Accordingly, the writ petition, being devoid of merits, stands dismissed.
