This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Jajpur Sadar P.S. Case No.241 of 2021 corresponding to C.T. Case No.1916 of 2021, pending before the learned S.D.J.M., Jajpur, for offences under Sections 413/414/120-B of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District & Sessions Judge, Jajpur, by order dated 01.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner has been implicated in the case at hand because of his criminal proclivity. It is also submitted that the co-accused has been released on bail by order dated 21.03.2022 in BLAPL No.1649 of 2022, hence on the ground of parity the petitioner seeks release.

Learned counsel for the State opposes the prayer for bail inter alia on the ground that the petitioner has criminal proclivity of similar nature.

Considering the release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the jurisdictional police station once every week till conclusion of trial.

Accordingly, the BLAPL stands disposed of.
