This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner is permitted to correct the cause title to add the offence of Section 406 of the IPC. 4.

The petitioner is accused in Purunakote P.S. Case No.36 of 2021 corresponding to G.R. Case No.500 of 2021, pending before the learned S.D.J.M., Angul, for offences under Sections 436/379/406/294/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Angul, by order dated 02.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the nature of allegations and the period of custody since 02.09.2022 and filing of the charge-sheet,

this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.

While releasing the petitioner on bail the learned Court below shall verify such assertion. If it comes to the fore that the petitioner has any criminal antecedent this order shall stand recalled without any further reference to this Court 9.

Accordingly, the BLAPL stands disposed of.
