This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for Petitioner and learned counsel appearing for the State- Opposite Parties.

The present Writ Petition has been filed with the following prayer:- " (i) Quash the memorandum of Charge vide No.29834/H dated 17.11.2012 at Annexure-3;

(ii) And may be pleased to direct the O.P. to grant all service benefits including retirement dues which have been held up due to pending proceeding in favour of the petitioner within a stipulated period of time.

(iii) Pass such other order(s), direction (s) as deem fit and proper to the facts and circumstances of the case to give complete relief to the petitioner.

(iv) And for this act of kindness, the petitioner as in duty bound shall ever pray".

It is submitted that even though the proceeding was initiated with service of charges on 17.11.2012, but till date the proceeding is yet to be finally disposed of and because of the pendency of the proceeding, the Petitioner is unable to get

// 2 // retiral benefits, even though he has retired from service since 31.12.2019.

In view of such circumstances, this Court while disposing the Writ Petition directs the Opposite Parties to conclude the proceeding so initiated against the Petitioner on 17.11.2012 within a period of six months from today, if there is no legal other legal impediment. The petitioner is directed to cooperate with the inquiry.
