This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. 3.

Learned counsel Mr. A. Acharya has appeared on behalf of the informant/victim. Vakalatnama filed on behalf of the informant/victim is taken on record.

The petitioner is accused in Kishorenagar P.S. Case No.132 of 2022 corresponding to G.R. Case No.766 of 2022, pending in the Court of the learned S.D.J.M., Athmallik, for alleged commission of offences under Sections 376(2)(n)/417/294/506/34 of the IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Athmallik, by order dated 01.09.2022 in the aforementioned case, the present BLAPL has been filed.

On instruction the learned counsel for the informant submits that the informant/victim does not want to proceed with the case.

Taking note of the same, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. Before so releasing learned Court is requested to verify the veracity that the matter has been compromised. 8.

Accordingly, the BLAPL stands disposed of.
