Heard learned counsel appearing for the parties. 2.

The sole question involved as to whether the Election Petition No.4 of 2022 is proceeded involving Election Officer as one of the opposite party. For the opinion of this Court, Election Officer herein as a party, may be only for the purpose of ensuring production of records and if necessary to assist the Election Tribunal any further. 3.

There is no dispute that Election Officer herein in such dispute have very limited role. At the same time, this Court also finds there may not be any prejudice to the elected candidate, if a election dispute continues involving Election Officer. As this Court finds no prejudice to either of the parties in the presence of the Election Officer as a party to the proceeding, this Court is not inclined to interfere in the impugned order. This Court accordingly dismisses the writ petition for having no merit.
