This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Khordha Model Police Station bearing P.S. Case No.308 dated 29.06.2022 corresponding to G.R. Case No.1053 of 2022, pending in the Court of learned S.D.J.M., Khordha, for offences under Sections 341/323/294/353/307/506/34 of IPC read with Section 52(a) of Orissa Excise Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Khurda, by order dated 25.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the rejection order.

Taking into account the release of the co-accused on anticipatory bail by order dated 27.07.2022 in ABLAPL No.8311 of 2022, by order dated 11.08.2022 in ABLAPL No.9541 of 2022, by

order dated and release of another co-accused on bail by order dated 23.08.2022 in BLAPL No.7278 of 2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
