This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Thuamul Rampur P.S. Case No.128 of 2022 corresponding to C.T. Case No.148 of 2022, pending in the Court of learned J.M.F.C., Jaipatna, for offences under Sections 384/387/385/506/509/109 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna, by order dated 04.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 23.06.2022 and as charge-sheet has already been filed in the meanwhile on 21.08.2022, further continuance of the petitioner in custody is punitive and hence seeks for release on bail.

Learned counsel for the State opposes the prayer for bail inter alia on the ground that the petitioner has criminal antecedents. 7.

Taking into account the period of custody and filing of preliminary charge-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

In view of the criminal antecedents of the petitioner, it is directed that the petitioner shall appear before the local police station once every week till conclusion of trial and such appearance shall be certified to the learned Court in seisin over the matter. 9.

Accordingly, the BLAPL stands disposed of.
