This matter is taken up through hybrid mode.

The Petitioner in this CMP seeks for a direction for early disposal of C.S. No.529 of 2019 pending before learned Civil Judge (Senior Division) Jaleswar.

Learned counsel for the Petitioner submits that the suit is ready for hearing and there is no legal impediment for early disposal of the same. Due to pendency of the suit, the Defendant No.8-Petitioner is highly prejudiced. Hence, he prays for the aforesaid relief.

Submission of learned counsel for the Petitioner and materials on record do not make clear the status of the suit. Hence, direction for early disposal of the suit cannot be granted at this stage. However, the Petitioner, if so advised, may file an application for early disposal of the suit stating the grounds therein after the suit becomes ready for hearing. In that event, learned Civil Judge (Senior Division), Jaleswar may do well to
