This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Nimapara P.S. Case No.167 of 2022 corresponding to G.R. Case No.480 of 2022, pending before the learned Additional Sessions Judge, Nimapara, for offences under Sections 292/376(1)/419/384/506 of IPC and Section 67(A) of I.T. Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Nimapara, by order dated 10.08.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that since charge-sheet has already been filed, further continuance of the petitioner in custody is unwarranted.

Such Submission is opposed by the learned counsel for the State inter alia on the ground that charge-sheet was filed showing the petitioner as an absconder.

Taking into account the nature of allegations and filing of charge-sheet as stated and the age of the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
