Heard Mr. P.S. Nayak, learned counsel for the petitioners and Mr. S.S. Pradhan, learned Addl. Govt. Advocate. 2.

This application under Section 407 of Cr.P.C. has been filed by the petitioners praying for transfer of C.T. Case No.57 of 2013 pending in the Court of the learned Addl. District and Sessions Judge, Jajpur to the Court of the learned District and Sessions Judge, Jajpur.

In view of the proviso to Section 407(2) of the Cr.P.C., this application is not maintainable before this High Court. 4.

Mr. Nayak, learned counsel for the petitioners submits that the petitioner may be permitted to withdraw this TRPCRL in order to approach the appropriate forum.

The TRPCRL is disposed of as not maintainable. Issue urgent certified copy as per rules.
