This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Purushottampur P.S. Case No.296 of 2020 corresponding to G.R. Case No.104 of 2020, pending in the Court of the learned Adhoc Additional District & Sessions Judge (FTSC) under POCSO Act, Berhampur, Ganjam, for alleged commission of offences under Sections 341/377/294/506 of IPC and Section 6 of the POCSO Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Adhoc Additional District & Sessions Judge (FTSC) under POCSO Act, Berhampur, Ganjam, by order dated 08.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the allegations that in the meanwhile trial has commenced as stated, this Court is not inclined to entertain this bail application of the petitioner at this stage, learned Court in seisin over the matter is called upon to conclude the trial within a period of four months from the date of receipt/production of this same order, failing which it shall be open to the petitioner to move for bail afresh.

Accordingly, the BLAPL stands disposed of.
